Welcome to MindTerrarium. The terms “we”, “us”, and “our” refer to MindTerrarium. We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). MindTerrarium is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies referenced here, describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, please do not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to the Terms, you represent that you are at least the age of majority in your place of residence, and you consent to any minor dependents using the Services on devices you own, purchase, or manage.

You may be asked to provide information such as your email, billing, payment, and shipping details. You represent and warrant that all information you provide is accurate, current, and complete and that you have the rights to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any person.

SECTION 2 – OUR PRODUCTS (PRINT-ON-DEMAND)

Most items are made to order (print-on-demand) and produced by our vetted fulfillment partners. Minor variations in color, positioning, or scale can occur due to device display settings, printing processes, and fabric/material differences. Product mockups and lifestyle images are illustrative; final goods may differ slightly.

We make reasonable efforts to describe and display products accurately, but we do not warrant that the appearance or quality will meet your expectations.

Product descriptions, specifications, and availability may change without notice. We may discontinue products or limit quantities at our discretion.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. We reserve the right to accept or decline your order at our discretion. An order is accepted when we confirm and process your payment.

Made-to-order workflow: Once production begins, we generally cannot accommodate cancellations or changes (e.g., size, color, shipping address). Please review your cart carefully before checkout and consult sizing charts where applicable.

If we decline or cancel your order (e.g., suspected fraud, inventory or address issues), we’ll attempt to notify you using the contact details provided.

Your purchases are subject to our Return & Refund Policy. You represent and warrant that purchases are for personal/household use and not for commercial resale or export.

SECTION 4 – PRICES, TAXES, DUTIES & BILLING

Prices, discounts, and promotions may change without notice. The price at checkout is the price in effect at the time of order and will be shown in your confirmation. Unless expressly stated, prices exclude shipping, taxes, customs, and import duties/fees (which, if applicable, are your responsibility).

You agree to provide current, complete, and accurate purchase and payment information, and to promptly update it so we can complete transactions and contact you as needed.

You represent and warrant that (i) the payment method you provide is valid and authorized, (ii) charges will be honored, and (iii) you will pay all charges, including shipping and taxes. Unauthorized chargebacks may be treated as fraud and referred to our payment processor for investigation.

SECTION 5 – SHIPPING & DELIVERY

Estimated delivery windows are estimates only, not guarantees. We are not liable for delays caused by carriers, customs, or events outside our control.

Orders may ship from different facilities and may arrive in multiple packages. Title and risk of loss pass to you when we transfer products to the carrier using the address you provided. Please ensure your shipping address is accurate; we are not responsible for non-delivery due to address errors.

SECTION 6 – INTELLECTUAL PROPERTY

The Services and all related content and materials (text, graphics, images, logos, videos, etc.) are owned by MindTerrarium or its licensors and are protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not copy, modify, distribute, display, perform, create derivative works from, or exploit any content without our prior written consent.

MindTerrarium names, logos, and related marks are trademarks of MindTerrarium or its licensors. You may not use such marks without written permission. Shopify marks are the property of Shopify. Other marks belong to their respective owners. All rights not expressly granted are reserved.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use of third-party tools is at your own risk and subject to the third party’s terms. Future features or tools we release are also subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to third-party websites or embedded content. We do not control or endorse third-party sites and are not responsible for their content, policies, or practices. Accessing third-party sites is at your own risk. Direct any questions or claims about third-party products or services to the third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

MindTerrarium is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with MindTerrarium. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MindTerrarium, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MindTerrarium.

SECTION 10 – PRIVACY POLICY

Your personal information is handled in accordance with our Privacy Policy and Shopify’s privacy practices. Because we use Shopify to host our store, Shopify may collect and process personal information about your access to and use of the Services in order to provide and improve the Services. You agree to use the Services lawfully and not to:

  • violate laws or regulations;

  • infringe intellectual property or privacy rights;

  • harass, abuse, defame, or harm others;

  • transmit misleading, illegal, or malicious content;

Provisions that by nature survive termination shall survive, including Intellectual Property, Feedback, Disclaimers, Limitations of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy.

Except as expressly stated by MindTerrarium, the Services and all products offered through the Services are provided “as is” and “as available.” We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that information will be accurate or reliable. Some jurisdictions do not allow certain disclaimers; in such jurisdictions, the foregoing will apply to the fullest extent permitted by law.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no event will MindTerrarium, Shopify, or our respective officers, employees, agents, service providers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Services or products, even if advised of the possibility. Our aggregate liability for any claim will not exceed the amount you paid for the applicable product(s) giving rise to the claim.

You agree to indemnify and hold harmless MindTerrarium, Shopify, and our affiliates, officers, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of: (1) your breach of these Terms; (2) your violation of law or third-party rights; or (3) your use of the Services. We may control the defense and settlement of indemnified claims; you will reasonably cooperate.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remainder will remain in full force and effect.

You and MindTerrarium consent to the exclusive jurisdiction and venue of the courts located in Bangkok, Thailand (or the competent courts therein), without regard to conflict-of-laws principles. Mandatory consumer protections under your local law will apply where required.
